These Terms of Use (“Terms”) govern your access to and use of the FreightFixed website (the “Site”). The Site is operated by FreightFixed (“FreightFixed”, “we”, “us”, “our”).
By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.
We may update these Terms from time to time. Changes take effect when published on the Site. Your continued use of the Site after changes are posted means you accept the updated Terms.
Content on the Site is provided for general information only. It does not constitute financial, legal, tax, operational, or other professional advice. You should obtain advice tailored to your circumstances before acting on information from the Site.
FreightFixed provides freight cost benchmarking and governance services, including benchmarking invoices against wholesale buy-rates and, where agreed, end-to-end shipment execution using third-party carriers and service partners.
Any services, fees, savings calculations, deliverables (including any “Proof Review” or “Proof Pack”), and timelines are subject to separate written agreement(s) between you and FreightFixed. Nothing on the Site forms a binding offer to supply services.
You agree not to use the Site in any way that is unlawful or prohibited by these Terms, including by:
interfering with, damaging, disabling, overburdening, or impairing the Site;
attempting to gain unauthorised access to any part of the Site, systems, or networks;
introducing viruses, malware, or other harmful code;
scraping, harvesting, or collecting data (including email addresses) without consent;
using the Site to send spam or unsolicited communications; or
using the Site in a way that infringes any person’s rights.
The Site may contain links to third-party websites (“Linked Sites”). Linked Sites are not under our control. We do not endorse and are not responsible for the content, availability, accuracy, or practices of any Linked Site. Access Linked Sites at your own risk.
If the Site allows you to submit information (for example via forms, uploads, feedback, or enquiries), you:
warrant that you have the right to provide the information and that it is accurate to the best of your knowledge; and
agree not to submit confidential information unless requested by us and protected by an applicable agreement.
You grant FreightFixed a non-exclusive, worldwide, royalty-free licence to use and reproduce your submissions to operate and improve the Site and to respond to your request. We may remove or refuse to publish submissions at our discretion.
Unless stated otherwise, FreightFixed owns or licences the content on the Site, including text, graphics, logos, and layout. You may view and print pages for personal or internal business use only. You must not reproduce, distribute, modify, create derivative works from, or commercially exploit any content without our prior written consent, except as permitted by law.
To the maximum extent permitted by law:
the Site and its content are provided “as is” and “as available” without warranties of any kind, express or implied; and
FreightFixed does not warrant that the Site will be uninterrupted, secure, error-free, or free from harmful components.
To the maximum extent permitted by law, FreightFixed is not liable for any loss or damage (including indirect or consequential loss, loss of profits, loss of data, or business interruption) arising from or connected with your use of, or inability to use, the Site or any Linked Site.
If the Australian Consumer Law or other legislation implies any condition, warranty, or guarantee that cannot be excluded, our liability is limited to the maximum extent permitted by law.
Our collection and handling of personal information is governed by our Privacy Policy (available on the Site). By using the Site, you consent to our handling of personal information as described in that policy.
We may suspend or terminate your access to the Site at any time, without notice, if we reasonably believe you have breached these Terms or if required for security, maintenance, or legal compliance.
These Terms are governed by the laws of the State of Victoria, Australia. You submit to the non-exclusive jurisdiction of the courts of Victoria and the Commonwealth of Australia.
